The complaint clearly spells out the criminal behaviour of the co-conspiring entities which acted in concert while participating and perpetrating enormous FRAUD in OHIO's foreclosures.  Our former Attorney General along with some powerful legal allies have filed this action on behalf of a proposed class consisting of:

ALL OHIO CITIZENS who were (a) defendants in judicial foreclosure actions {with} first lien mortgages on their homes that were purportedly held by securitization trusts, and that were knowingly initiated and prosecuted by Defendants on behalf of parties that lacked legal standing to do so, and (b) who were damaged by Defendants’ abusive foreclosure practices, including: (i) preparing, executing, and notarizing fraudulent court documents and assignments of mortgages and other property records that were used to initiate and prosecute such foreclosures, and (ii) imposing inflated, unfair, unreasonable and/or fabricated fees for “default management services” (the “Class”)
Three (3) categories of defendants {Servicers, Foreclosure document venders, and Foreclosure Mills) acted in concert and conspired in furtherance of the fraudulent scheme to generate enormous profits from default servicing fees by knowingly initiating foreclosure actions on behalf of entities that lacked legal standing to bring such actions.

Sadly, in what appeared to be an instant counter action and outrageous and unconscionable retaliatory attack - a 10-day eviction notice was posted on Plaintiff Michael and Laura YEAGER's home - the day after the complaint was filed! It has since been followed up with another! The PREDATOR DRONE foreclosure mill law firm (REIMER, ARNOVITZ, CHERNEK& JEFFREY CO LPA ) apparently tasked co-defendant paper filing drones' (Manley Deas Kocholski) to execute the writ-of-possession while the morally corrupt  bank sponsored attorney - Kristi Pallen* - (kpallen@reimerlaw.com) (330-405-1199) continues the fight to legally block the Yeager's request for a  Stay (of an eviction). Reimer (Pallen) has also refused a supersedeas property bond offer (collateral), or to accept a previously agreed upon short sale.

The Court finds Plaintiff’s counsel (Kristi Brown kna Kristi Pallen) did not follow Local Rule 4.2. filing procedures for service by Certified Mail....and...
The Court strikes all entries pertaining to service and further, the Court finds Plaintiff’s counsel failed to prosecute this matter...and.. Therefore, it is ORDERED this case is dismissed, without prejudice, .....and for Want of Prosecution. It is further ORDERED this case is dismissed... for failure to perfect service within 120 days, according to Fed.R.Civ.P 4.

Robo Signing - While our government was sleeping !

Below, some shocking news (cough-cough) that apparently happened while our government was sleeping! In a total surprise (except for homeowners) it appears fraudulent robo-signing continued, as Attorney Generals sold out attention was focused on cutting a sweetheart deal with the five largest mortgage servicers: Bank of America, Citigroup, JPMorgan Chase, Wells Fargo and Ally Financial. Of course they all agreed to a $25 billion settlement without admitting wrongdoing. (Collectively paying 25 billion!...for no wrongdoing...Really!)

Carla Duncan is fighting a foreclosure lawsuit on her home in Cleveland Heights, Ohio
Carla Duncan, a social worker, is {still} fighting a lawsuit over the foreclosure on her three-bedroom home in Cleveland Heights, Ohio. The lawsuit, which was filed in March 2010 in Ohio state court, includes a {mortgage assignment} document signed by {an admitted and known robo-signer} Ms. Erica Johnson-Seck. In July 2010, Erica Johnson-Seck, whose signatures appeared in {thousands of} foreclosure cases acknowledged, in a deposition....to having signed 750 mortgage documents a week, usually with only a cursory review.
“It’s so totally unfair {to have to fight their fraudulent submissions}” said Ms. Duncan.

In October 2010, Garr M. King, a senior judge with the United States District Court in Oregon, blocked a foreclosure after spotting a suspicious document from {another admitted and known robo-signer}Ms. Noriega. In that lawsuit, Ms. Noriega, acting as vice president of Mortgage Electronic Registration Systems,(MERS) signed an assignment of mortgage. The problem, court records show, was with the date. Ms. Noriega’s signature {purportedly} transferring the mortgage from Mortgage Lenders Network (MLN) to LaSalle National Bank (now part of Bank of America) was dated 15 months after MLN halted its operations.

Despite the pledges of the giant servicers to amend their practices, there are signs that foreclosure cases with other companies remain problematic. An examination of dozens of court cases by The New York Times found questionable documents involving some of {the below} eight institutions. HSBC (United States bank division), SunTrust Bank, MetLife, U.S. Bancorp, PNC Financial Services, EverBank, OneWest and Goldman Sachs. In addition, judges, lawyers and advocates for homeowners say that people are still losing their homes despite improper documentation and other flaws in the foreclosure process often involving these firms. The eight firms cited by the Federal Reserve “should be fined for unsafe and unsound practices in their loan servicing and foreclosure processing,” Suzanne G. Killian, a senior associate director of the Federal Reserve’s Division of Consumer and Community Affairs, told lawmakers last month in a House Oversight Committee hearing in Brooklyn. Marie McDonald (McDonnell Property Analytics) through a legal affidavit, explained the results of her independent audit of Register John O’Brien's registry. It reads in part:  ...."the banks set up in-house document execution teams, or outsourced the  preparation of their assignments to third parties who manufactured them out of thin air without researching who really owns the mortgage.… "What this means is that the degradation in standards .....so fatally flawed that the institutions, including many pension funds, that purchased these mortgages don’t actually own them because the assignments of mortgage were never prepared, executed and delivered ....in the normal course of business at the time of the transaction.

FLORIDA:                                    R. B. "CHIPS" SHORE - Manatee County - Clerk        As Florida’s foreclosure crisis continues, Manatee County Clerk of the Circuit Court & Comptroller, R.B. “Chips” Shore, suggests that property owners conduct regular and routine public records searches for faulty liens and other documents that may be filed against their property. As the foreclosure process and “foreclosure mills” came under scrutiny for inaccurate documentation and other issues, the need to show clear and accurate title to one’s property came to the forefront.
Who's authorizing the filing of FRAUDulent documents on Florida property owners?

WASHINGTON:
Washington State Attorney General (Rob McKenna) filed a lawsuit against the Bank of America's "Recon Trust" for conducting ILLEGAL FORECLOSURES on THOUSANDS of Washington State homeowners. The suit alleges, amongst many charges, that "ReconTrust":

  • CREATED or permitted the use of documents that were FRUADulently and improperly executed, notarized or sworn to....and the notices and agreements contained conflicting dates and improper notarizations and ReconTrust employees sometimes FRAUDulently signed as officers of other entities.


  • "ReconTrust ... repeatedly broke the law and refused to provide information requested during our investigation," McKenna said. “ReconTrust’s illegal practices make it difficult, if not impossible, for borrowers ... to stop those foreclosures.”

    PENNSYLVANIA:
    Montgomery County Recorder of Deeds Nancy Becker is urging registers of deeds across state and the country to withdraw public money from any banks affiliated with the Mortgage Electronic Registry System (MERS), which she claims is undermining the practice of accurate land recording.
    "In recent years, mortgages have been assigned and reassigned multiple times, and when a bank or other entity doesn’t properly report these transfers, it makes it very difficult for homeowners to determine who holds their mortgages. It clouds the chain of title, and it’s prohibiting (officials) from recording revenues they should be recording," Becker said.

    Michigan AG office DEMANDS "Robo-Signing" investigation

    FRAUD BOMBSHELL: Michigan Attorney General Bill Schuette Subpoenas LPS !!

    The Michigan Attorney Generals office issued subpoenas as part of a CRIMINAL investigation into questionable mortgage documentation filed with Michigan’s Register of Deeds offices. Michigan Attorney General Bill Schuette said his office served Lender Processing Systems(LPS), Fidelity National Financial, and CT Corporation System. Additional investigative subpoenas were issued to LPS owned company - DocX. The subpoenas were approved by the state court and require responses by June 30.

    DocX employees - earning $10 an hour and creating 4,000 documents a day - were all released when their rubber-armed & "robo-signed" creations were found to be have been FRAUDulently used - as evidence - to foreclose on millions of home - across the U.S. Of course, when closing the DocX office, an LPS spokesperson claimed "we executed documents per industry standards" (FRAUD, forged, illegal, bogus)
