Underwater Homeowner Vote may turn election

The cheer leading and rah-rah, heard at the presidential conventions, has long since died down. BUT, both candidates left a huge election topic (Housing) unaddressed, and as a result, the door is now wide open, to speak directly on Foreclosures and Underwater Homeowners. It is important that both men address these two (2) related issues instead of repeating & summarizing all the problems by using drone like rhetoric and simply calling it a Housing Crisis.

ELECTION NEWSFLASH:
President Obama - you - and Governor Romney will be competing for votes of millions of homeowners. As presidential candidates, you need to address the housing issues (Underwater Mortgages, Foreclosure, Fraudclosure, principal reduction) especially in big swing states such as Ohio, Colorado, Nevada and Florida. Current estimates show there are between 12 - 16 million underwater homeowners,


3 Americans Speak About Foreclosure & Underwater Housing (OH, NV, CO)

OHIO:
The housing crisis has hit OHIO harder....than but a handful of states. As a result, many OHIO VOTERS are underwater on their mortgages (mortgage debt is greater than value of home) Recent housing market data shows more than a half a million (529,834) OHIO mortgages are underwater. What does that mean?

*1 Million (1,000,258) Ohio eligible voters are underwater
12% of the eligible voters - underwater & 528,834 home mortgages - underwater

*To put these numbers in perspective, the number of Underwater Voters in Ohio (1,000,258) is OVER 1/3 of the total votes cast for the winning presidential candidate in 2008.

Listen-up folks....I was just another FRAUADclosed upon homeowner...... living in Ohio, when exactly 8 months ago (April 23, 2011) I tried to thank, in a post, some people that had inspired me. These individuals gave me the courage needed to stand-up and be heard (by blogging)  
I wrote back then:
..........I must give a "Shout-Out" and public "Thank You" to attorneys that have given me courage and inspiration to take this first step (Blog). A THANK YOU - to the individuals below - is simply not enough. They are the brave ones that accepted and took up the fight, long ago. They paved the way for those of us that followed. The below attorneys have been waging legal battles in FL. courtrooms, and uncovering crimes by revealing the massive FRAUD being perpetrated in foreclosures.They have been dealing with these issues much better and longer than we have (in OHIO). They continue to change law, awaken lawmakers, save homes and improve the lives of thousands of people. Floridians, these are your state's heroes!

In the meantime, I knew there was this AMAZING gal (Lisa Epstein) down in West Palm Beach with a cool website - Foreclosure Hamlet - that was loaded with foreclosure defense information. Lisa can only be described - as a person with unbelievable courage. She, like me, had been going through an awakening of the FRAUD in foreclosure. But instead of "hiding in the shadows" or being allowed to be labeled as a victim, Lisa took action. She wrote letters, went to the courts, uncovered fraud, challenged the system, notified the Florida State Attorney General's Office of the Fraud upon the courts. She went to her State Senators and Representatives.....and knocked on congressional doors and called attorneys....and fought on...and on...day and night. No matter what the odds....or size of the enemy....she refused to back down. In the same post (of April 23, 2011) I feebly tried to thank Lisa... and promising to post some of her inspirational work...I said:
...... And finally we will focus on Lisa Epstein, the Rosa Parks of Foreclosure. She refused to "give up her house," or be pushed aside or out of the courtroom. She is truly a hero and you will be inspired (as I was) by her story. I will dedicate a couple posts to her, as she has forever changed the landscape for those in Foreclosure
I've failed to feature my hero (Lisa) in a post....but she continues to inspire me.... daily .....

 OHIO FRAUDclosure - A Thank You to FLORIDA Attorneys

Lastly, I had planned for some time to have a special blog post featuring my friend ....Martin. It is still a planned and upcoming post...but in the meantime.....rewind three years back. I'm in the midst of my own personal FRAUDclosure fight, when late one night I stumbled upon this amazing writer and blogger - Martin Andelman. Man could this guy write! He seemed to take all the complexities of the financial crisis and near wipe-out and meltdown (still in progress) of the US Housing market...and somehow.....make some sense out of it. I would read and re-read each of his posts. It was amazing how he could take a serious topic (Obama HAMP program) and make it......I have to admit.... really funny. First he would write about the serious side of the issue - then have you laughing out loud - then walk you to a point of being mad - to damn mad - to crazy mad .....and then to....well kinda back...full circle to the topic at hand. He left you wondering, thinking, and asking questions. He has this artistic writing style that seems to empower and give each of us the ability to NOT accept the government's sound bite answers(lies) being spewed 24-7 by the traditional media. One thing that came through...in each of his posts (Now numbering 520+) was the breadth of his knowledge to go along with his ability.... to simplify it all.....in a Mandelman Matters blog.

Occupy Movement... turns attention ...to Foreclosures

OccupyWallStreet has turned its national attention to the topic of FORECLOSURE
The movement officially released their support for a National Day of Action (HERE)
OHIO FRAUDclosure is a proud participant, planner, and supporter !!!

On Tues. December 6th visit this blog for LIVE updates, streaming video, and pictures from in and around OHIO during a day long "look-in" on the action

"This {day} is a shift from protesting Wall Street fraud to taking action on behalf of people who were harmed by it. It brings the movement into the neighborhoods and gives people a sense of what’s really at stake," said Max Berger, one of the Occupy Our Homes organizers and a member of Occupy Wall Street’s working group

DECEMBER 6th - National Day of Action
OCCUPY OUR HOMES 
The OccupyWallStreet movement and brave homeowners around the country are coming together On Tuesday December 6th, We - the 99% will stand up to Wall Street banks and demand they negotiate with homeowners .....instead of fraudulently foreclosing on them

Like many of the Occupy actions that have focused on specific policy questions, this one is being organized by established groups along with their allies in the movement. Among the allied groups listed on the Occupy Our Homes website is OHIO FRAUDclosure !!!

Occupy Wall Street is promising a "big day of action" Dec. 6 that will focus on the foreclosure crisis and protest "fraudulent lending practices," "corrupt securitization," and illegal evictions by banks. The day will mark the beginning of an Occupy Our Homes campaign that organizers hope will energize the movement.

Many of the details aren’t yet public, but protesters in 20 cities are expected to take part in the day of action next Tuesday. We’ve already seen eviction defenses at foreclosed properties around the country as well as takeovers of vacant properties for homeless families. Occupy Our Homes organizer Abby Clark tells me protesters are planning a "mic-check" to disrupt foreclosure auctions as well as launch some new home occupations.

On the Occupy Wall Street side of things, members of the direct action working group and the movement-building group in New York have been involved in the project. A network of groups organized as Take Back the Land has been doing eviction defenses and related actions around the country for five years, according to organizer Max Rameau."Now with this Occupy movement ramping up, I think we have a significant chance to keep large numbers of people in their home,"  

“[The goal is to] not only force the banks to allow the family to stay in the home. But also then force policy changes that would help thousands of other people for whom we’re not doing eviction defenses.”...Rameau told Democracy Now earlier this month.

D-Day is coming...Occupy our Homes


DECEMBER 6th - National Day of Action
OCCUPY OUR HOMES 
The OccupyWallStreet movement and brave homeowners around the country are coming together to say, "Enough is enough." We, the 99%, are standing up to Wall Street banks and demanding they negotiate with homeowners instead of fraudulently foreclosing on them.
 
Everyone deserves to have a roof over their head and a place to call home. Millions of Americans have worked hard for years for the opportunity to own their own home; for others, it remains a distant goal. For all of us, having a decent place to live for ourselves and our families is the most fundamental part of the American dream, a source of security and pride.

In 2008, we discovered bankers and speculators had been gambling with our most valuable asset, our homes--betting against us and destroying trillions of dollars of our wealth. Now, because of the foreclosure crisis Wall Street banks created with their lies and greed, millions of Americans have lost their homes, and one in four homeowners are currently underwater on their mortgage.

Not only do we have thousands of people without homes, we have thousands of homes without people. Boarded-up houses are sitting empty--increasing crime, lowering the value of other homes in the neighborhood, erasing the wealth that lifts families into the middle class.

A growing number of homeowners & supporters are standing up to the banks & demanding that the banks correct the mortgage principal to fair market value. 
 I will:
Resist attempts by the FRAUDsters (banks & servicers) to "steal" our homes. 
Take necessary action(s) to Support American Homeowners.

• If they attempt to evict, I will not go
• If they attempt to "Steal" my neighbors home, I will stand with my neighbor in solidarity
I will:

- make phone calls
- contact caring - local and national organizations
- join efforts of local and national organizations that help with foreclosure defense & to help stop evictions
- help spread the word

OCCUPY Minneapolis formed a human chain around Sa'ra Kaiser's foreclosed home, preventing the officers from boarding it up, and ultimately forcing the police - who had no legitimate legal pretense for preventing occupiers from being their in the first place - to give up. US BANK wanted to evict another homeowner and blight another house and neighborhood.

YOUNGSTOWN OHIO is now OCCUPIED

A small Midwest "All-American City" - YOUNGSTOWN OHIO - is now OCCUPIED
Crowds gathered and peacefully protested with no interference from 6 area "Closed" Banks.
JP Morgan Chase was locked-up and closed. They have no need to conduct business on Saturday. J.P. Morgan Chase could care less about their "city" customers' or their weekend financial needs.... moreover they cannot file any FRAUDclosure actions against homeowners on Saturdays.... so why bother to open?  Photo below is courtesy of Business Journal Daily

Demonstrators cheered and waved signs as speakers denounced the surrounding banks & corporate business practices.
YOUNGSTOWN, Ohio - Young and old, black and white -- a diverse crowd -- many of them carrying hand-painted signs, gathered on Central Square at noon today for the Occupy Youngstown protest. ..... elected officials were there -- among them Youngstown Mayor Charles Sammarone, Municipal Clerk of Courts Sarah Brown-Clark and Councilman John Swierz.

U.S. STATE Rep. Robert Hagan, D-Youngstown, was the only elected official to speak:
"The people in these banks," Hagan thundered, gesturing toward the downtown office of First National Bank, "the people up there in the chamber of commerce," he continued, pointing to the 17th floor of the bank building, "they're the ones who started this [class] war. And guess who's going to finish it -- we are!"

As strong winds chilled the crowd....speakers stood on a temporary platform and, one by one, denounced the 1% who control 40% of the nation's wealth. The OHIO FRAUDclosure blogspot author, was a featured speaker. He gave a stirring and impassioned 15 minute speech to an engaged and chanting crowd, which included an introduction to Youngstown based attorney - Bruce Broyles. Attorney Broyles is the brave attorney who submitted a brief, on behalf of OHIO FRAUDclosure and Ohio homeowners, in the landmark Ohio Supreme Court Case US BANK v. Duvall.

Ohio Supreme Court's Shocking Decision in Landmark Case

               U.S. Bank National Assoc. v. Antoine Duvall et al.
                                                        CASE Number 2011-0218     

                    CASE DISMISSED as MOOT
   
A Simple question was before the OHIO SUPREME COURT JUSTICES:

To have STANDING, as a plaintiff, in a mortgage foreclosure action, must a party show that it owned the NOTE and the MORTGAGE when the complaint was filed?

OHIO's highest court  - took the easy way out  - with a simple one page ruling 
(HERE) which completely avoids succinctly resolving this issue and now leaves a number of identical cases and litigation - still before them. We had heard from a multiple of sources, attorneys, and "insiders".... that this was the best and easiest "way-out" and a "back- door" solution for Ohio's Highest Court and Judges. The court - once again "buried" the no decision on the LAST PAGE (15th) of Case Announcements(HERE - on the fifteenth and last page under MISCELLANEOUS DISMISSALS)

The MOOTNESS decision was a predicated result, after a well planned out and orchestrated effort to get this case "Kicked." You see US Bank NA had failed in their three (3) previous attempts to FRAUDulently foreclose  - on the DUVALLS (with a phony undelivered and improperly indorsed note along with a post filing FRAUDulent robo-signed mortgage assignment)

So after initially "Certifying a Conflict" as a way to get this case heard by the court ....the ending (DISMISSAL) from Ohio's Supreme Court... was short and simple:

HOW had DUVALL's three year legal battle......suddenly become MOOT ???

How was the "CASE of the CENTURY" .....suddenly and quietly dissmissed ???
Well it appears that Wells Fargo and US Bank decided to satisfy (pay in FULL) the Duvall mortgage once they realised that this case would be scrutinized at the highest Level (and all the Fraud Exposed) See (below) a copy of the suddenly satisfied mortgage - and a change from a predator drone foreclosure mill fraudsters to a financial "Santa Claus"

......Interestingly, according to footnote 1 of U.S. Bank's Memorandum regarding notice of suggestion of mootness, counsel representing the bankster in this case notes that it also represents the banksters involved in the other two cases. It remains to be seen if the banksters in those cases are equally successful in 'buying off' the respective homeowners in foreclosures.....'

Ohio FRAUDclosure blogger brief to Supreme Court of Ohio

OHIO FRAUDclosure, an Internet "Blog Site," has submitted an Amicus Curiae (Brief) on behalf of ALL OHIO Homeowners in a landmark case US BANK NA v. DUVALL

This case and decision currently in front of the Supreme Court of Ohio - turn on the Question:

 To have STANDING, as a plaintiff, in a mortgage foreclosure action, must a party show that it owned the NOTE and the MORTGAGE when the complaint was filed?

OHIO FRAUDclosure blog and Ohio's 88 Civil Courts have repeatedly addressed this issue (linked below) and have answered the above question "in the affirmative" (Yes !).  However, US Bank NA, seems intent on spending millions in an attempt to get a second chance to change standing law in Ohio.

In an effort to "Blindfold Lady Justice" and twist the legal arm of the state's highest court US Bank NA "PAID IN FULL" the underlying Mortgage (Duvall) in an attempt to force Defendant homeowner counsel, along with plaintiff (Predator Drone Law Firm) to both suggest:
The case, the decision, and underlying question.....are now.... MOOT!
